In these Booking Conditions ‘Milkbere Cottage Holidays’ shall mean ‘Milkbere Cottage Holidays Ltd.’, the ‘customer’ shall mean the person signing the booking form, the ‘owner’ shall mean the owner of the holiday property.
In all cases Milkbere Cottage Holidays only act as Booking Agents on behalf of the Owner and any contract entered into is one between the Holidaymaker and the Owner of the property and Milkbere Cottage Holidays cannot be responsible for the actions of either Party or the consequences resulting there from. Neither is Milkbere Cottage Holidays responsible for any obligations or any promises made by Others, or for telephone descriptions. Milkbere Cottage Holidays have carefully inspected all properties featured in its Brochure and Website and has done its utmost to ensure that the details described are
accurate and they cannot accept responsibility for any interim changes of which they have not been notified and they do not accept responsibility should the Properties not conform to the Holiday maker’s own individual standards.
The person making the bookings will remain responsible for all members of his or her party. They should ensure that they are aware of the booking conditions and that they will meet the obligations arising therefrom in every way. The number of guests must not exceed the maximum stated in the property description. If these conditions are not met the owner of the property may refuse the right of entry to the property and no money will be refunded.

All booking alterations made after the payment of deposit will be subject to a surcharge of £30.00 providing the change is to the same property and where the owner of the property will agree to an alteration of dates, otherwise see section on cancellation.
Returnable Security Deposits are required at some properties. This is paid with the final balance and returned in full unless there are charges made for breakage, damage and excess cleaning.
These bookings are to be paid for either by Credit Card or by Bankers Draft (amount to be checked with office). Remitters to pay all Bank Charges if applicable.
If in the opinion of the customer the accommodation is unsatisfactory the customer should first bring his complaints to the notice of the owner or keyholder immediately. If after these steps have been taken satisfaction is not obtained the matter should be reported promptly to our Seaton office, telephone 20729, so that the matter may be investigated and resolved where possible. No complaints can be entertained or correspondence entered into if complaints are reported at the termination of the holiday or after the customer has vacated the property, or denied owners/agents the opportunity to rectify
any problems while in occupation.
We observe VisitBritain’s Code of Conduct and Milkbere reserves the right to refer a complaint to VisitBritain for arbitration if required.
Milkbere Cottage Holidays shall in no way be liable for loss, damage or injury caused by strike, industrial dispute, weather, war or other hostility, fire, flood, riot or civil commotion, nor for any defects or interruptions to supply of electricity, gas or water or other services. In no event shall the liability of Milkbere Cottage Holidays to the customer howsoever arising exceed the price paid for the relevant holiday.

Neither the owner nor Milkbere Cottage Holidays will be liable: for personal injury (other than resulting from their respective negligence) to the customer or any member of his party: for loss or damage to his property, including pets or for loss or damage to any car or its contents.
If between the date of publication of the current tariff and the first day of the reservation there shall be any increase in tax as a nature but not confined to VAT. Milkbere Cottage Holidays reserve the right to pass on a fair proportion of such increased cost to the hirer and as a condition of making and accepting the reservation the person signing the application agrees
In the unlikely event of the reserved property not being available through unforeseen circumstances Milkbere Cottage Holidays reserve the right to offer accommodation of a similar type or to refund all monies paid.
The customer agrees to pay for all gas, electricity, fuel and telephone charges where levied during the tenancy to pay for any losses or damages to property, however caused, reasonable wear and tear excluded, to take good care of the property and to leave it in a clean and tidy condition at the end of the hire period, to permit owners and agents reasonable access to the property, not to part with possession of the property or share it except with members of the party shown on the booking form, not cause annoyance or to become a nuisance to other persons who are occupants of adjoining premises. Customers
to report accidental damage when it happens so that it can be rectified ready for the next visitors.
All distances are approximate but are given to the best of our judgement and in good faith.
A charge will be made for returned and represented cheques.
In the event of a breach of the foregoing conditions, agreements and understandings, Milkbere Cottage Holidays shall have the right to enter the premises and re-take possession immediately and completely without compensation to the hirer.

Milkbere Cottage Holidays Ltd must be telephoned immediately you are aware you are unable to take your holiday.
All cancellations must be notified in writing within four working days of telephoning the office, giving full details of the reason, together with a doctor’s letter or other supporting documents as required.

Death, injury, serious illness of any member of those listed or close relative being a parent, brother, sister, child or dependant Jury service of any member of the party Posting of any member of the party in the armed services
Pregnancy • Death/injury/illness as a consequence of a condition known or occurring prior to booking • Any member of the party (or relative causing the cancellation), aged 70 years or over at the time of travel • Government regulations • Strikes • War • Terrorist activity • Revolution • Domestic dispute • Bad weather • Accident or illness of family pet •
Disinclination to travel • Change of employment • Changes to leave by employer • Claims of any nature relating to or connected with pandemic or epidemic illness or disease
This Plan terminates on the day the holiday starts
This Cancellation Plan is operated by Milkbere Cottage Holidays Ltd whose
decision is final
Where a cancellation is covered by its plan, full repayment will be made
less £30 and the booking fee.

In the event of a cancellation for any cause not covered by the holiday protection plan, our office must be notified immediately in writing and the customer will be subject to a charge so that we may compensate the owner and ourselves for estimated losses
Notification received
In excess of 42 days – the customer to pay the deposit only
41–21 days – 60% of the full cost of the holiday
21–7 days – 80% of the full cost of the holiday
Under 7 days – 100% of the full cost of the holiday
PLEASE NOTE: Once a booking has been confirmed, the person making the booking is responsible for the total costs shown thereon. The cancellation plan provides protection for all liabilities providing that the reasons for cancellation are within the terms of the scheme
